NY Debt Collectors Face Debt Collection Class Action Lawsuit

In January 2010, a debt collection class action lawsuit was filed against several New York debt collectors who are accused of one of the most notorious illegal debt collection methods known as "sewer service."

Sewer service refers to when a debt collector fails to serve a notice of complaint, and then subsequently applies for a default judgment. In most of these cases the debt collector wins when the debtor doesn't show up in court.

In this particular case, in which complaints were filed against 5 subsidiaries of Leucadia National, servers claimed to be in several places at the same time, and covering impossible distances. Meanwhile, the debtors claim they were never served at all. The New York attorney general's office is seeking to vacate more than 101,000 court judgments across the state that resulted in penalties and liens.
