Personal Injury and the Massachusetts Statute of Limitations

The Massachusetts statute of limitations, simply put, places a time limit on when someone can file a Massachusetts personal injury lawsuit. It's natural to want restitution if you've been hurt by another person's errors, but you must file your claim quickly. Otherwise, the courts will not accept it.

The deadlines established by the Massachusetts statute of limitations vary from case to case. Generally, a personal injury claim must be filed within 3 years of the time of the injury. However, in some cases, that deadline can be extended.

For instance, you may be able to benefit from something called statute tolling. If you could not file your claim on time, it might be possible to get an extension, provided you were unable to do so in the allotted time. This is especially helpful in lawsuits filed against the government, which have a very short deadline and require additional paperwork.

If you've suffered from a personal injury, but did not discover its severity until after the normal deadline, you may still be able to file a Massachusetts personal injury lawsuit. In what is known as the discovery rule, the Massachusetts statute of limitations allows for a new deadline set after the date of the injury's discovery. This deadline will still match the corresponding amount of time seen in a normal example of the case.
