The Elements of a Negligence Case Under Massachusetts Law

Have you been hurt because of another person's negligence? If so, take the time to learn about Massachusetts negligence laws. These laws were put in place so that you have a means of getting restitution in the event of injury caused by someone else's carelessness.

It can be helpful to familiarize yourself with some of the elements of negligence cases. One of these elements is duty, which the law defines as a person's responsibility for the safety of others. For instance, a car driver has the duty of driving in a way that is safe to other people on the road.

If someone injured you through negligence, and the court deems this person as having failed to do his or her duty, the situation falls under the category of breach of duty. This means that the other party may be liable for your injury. This is an important part in a Massachusetts personal injury lawsuit.

It must also be proven that the other party is responsible for your injury, and that you didn't the injury independently from their negligence. This is called the cause in fact. You must also be able to prove the extent of your own injuries.
