Wrongful Foreclosures and the "Trashing Out" of the American Dream

The term "trashing out" in the foreclosure world, refers to the process of entering a home that's been seized by a bank as part of the foreclosure process and then disposing of any of the contents that have been left behind by the home owners.  "Trash out" crews literally go into a seized home and haul away anything that is left in the house.

"Trashing out" is not a pretty sight , though, because it literally involves throwing people's possessions and personal property into a dumpster or the local landfill.  In a matter of hours, "trash out" crews can blast through a home and dispose of furniture, clothing, family photos, tools and children's games. 

In the trash out world, a family's possessions are measured in cubic yards, not memories.  Anything over 35 cubic yards of possessions to remove is considered a big job in the industry.

Imagine the injustice then when a home is wrongfully foreclosed on and seized by a bank that has no banking relationship with a homeowner and a "trash out" crew enters the home and disposes of all sorts of meaningful personal possesions.  In a larger sense, wrongful foreclosures are the "trashing out" of the American Dream.  

Banks are seizing American homes today at an alarming and unprecedented rate. Like a train running down the track, once a bank starts the foreclosure process it can be almost impossible to stop it. And, once a bank has "trashed out" a wrongfully seized home, there's no turning back. We want to hear stories from homeowners whose homes have been "trashed out" and from any former employees who worked on a "trash out" crew.

Our Real Estate office handles foreclosures and there are times, even when we tell the banks they need to wait before they send in a third party clean-up crew, that they've rushed in anyway. I'm aware of two occasions where that practice came back to bite them as they were litigated against, which cost them dearly. I'm not opposed to lawful actions by the banks, only fool hardy tactics when prudence would have benefited everyone.

This was done to us last year. We were in the process of moving our belongings out of our home in the anticipation of a Sheriffs Sale when my husband suffered a stroke. We were in the process of completing our move, when the sale was completed, but the 'trash out crew' came in 3 business days after the sale, without warning, without posting a notice of property eviction or even notifying the attornies for that matter. They originally told me they took it all to the dump. When I called back the following week to tell them I was suing them, they miraculously found some of my stuff in a storage shed...they returned some of it, but not the good stuff. And you're right, I've felt as if I've been raped of our rights, our belongings, etc. It's bad enough that we lost our home, but these vultures come in and destroy your property and without cause. This happened last March and the house they had to get their hands on is still sitting empty.

Oh my! I post many articles on my blog about bank foreclosure wrong doings, but this one is one of the worst cases of bank callousness and carelessness I have ever read! I never thought it through, but it does make some kind of evil sense to learn what "trash out" crews are doing to people as you describe.

I am sure they take great delight in raping a family's home and personal belongings, especially when they can find little valuables during the trashing.

I am going to re-post this article heading to my site with a back link so people can come here and read the whole thing. Thanks for pointing this out.
