What are "exemplary damages?"
A: Exemplary damages are oftentimes referred to as "punitive damages" and are commonly awarded in cases where a party's conduct is considered willful, oppresive, grossly unfair or reckless, or fraudulent. The intent of exemplary or punitive damages are to "punish" a party for the conduct in order to reform or deter that type of conduct in the future.
