What if my lender violates the HAMP rules?

If your lender violates Home Affordable Modification Program (HAMP) rules then you have a right to take legal action. This has been the case for a surprising number of homeowners who have been foreclosed on during the HAMP loan modification process.

At the moment, a California couple is suing Chase Bank for this very issue, and Bank of America is also facing a class action lawsuit for refusing to follow HAMP rules. The case with Bank of America relates to that lender's refusal to provide loan modifications under the government's HAMP program.

HAMP guidelines state that
:

  • Lending institutions must evaluate a borrower's request for a loan modification
  • Lending institutions cannot process a foreclosure while the evaluation is in process

 

While Bank of America has failed to evaluate borrowers' HAMP requests, the case with Chase is because of foreclosure during the loan modification process.

Because HAMP is a brand new program that was introduced by the Obama administration, there are still some issues that have to be worked out.
