What is Massachusetts' Minimum Insurance Coverage Requirement?

A:

When buying Massachusetts car insurance, it helps to know exactly what coverage is required and what they coverage does in the event of a Massachusetts car accident. Massachusetts is a no-fault state, which means that a driver who causes an accident is not held liable for any medical expenses. Instead, every individual must be covered by their own insurance provider.

If however, your injuries are severe enough to warrant medical bills beyond your insurance coverage and the other party was at fault for your injuries, you can file a Massachusetts personal injury lawsuit to recover further damages from the other driver's insurance company.

The state of Massachusetts requires that drivers have:

  • A minimum Bodily Injury Liability limit of $20,000 per injured person up to a total of $40,000 per accident
  • Property Damage Liability coverage with a minimum limit of $5,000
  • A minimum Personal Injury Protection (PIP) coverage of $8,000
  • A minimum Uninsured/Underinsured Motorist coverage of $20,000 per person up to a total of $40,000 per accident for any bodily injury caused by the uninsured and/or underinsured driver

This is the basic coverage that is required for Massachusetts car insurance. It is often called 20/40/5 coverage with UM limits.

Consulting with a Massachusetts injury attorney can help you determine what compensation you are entitled to and what your legal options are if further compensation is needed after a Massachusetts car accident.

What do each of the types of insurance cover?

Personal Injury Protection (PIP)
is to help each driver with their medical expenses, as well as with funeral expenses, or any lost wages.

Bodily Injury Liability Coverage and Damage Liability Coverage
will pay the medical expenses of the driver and for the repairs of the other vehicle involved, if the insured is determined to be at fault for these expenses.

Uninsured/Underinsured Motorist Coverage
is to pay for the damages to either vehicle or person, which was caused by an accident with an uninsured/underinsured motorist, or one who is unable to pay for the damages.
