What Can I Do About My Credit Card Rate Increases? (Part B)

The Credit Card Act of 2009

In May of 2009 President Barack Obama passed the Credit Card Act of 2009, which is meant to establish more fair and transparent practices by credit card companies.

The new legislation includes provisions that:

  • Require credit card companies to give 45 days notice of any rate increases
  • Give cardholders the ability to cancel their agreement and pay off their balance at their existing interest rate if they are informed of a rate increase
  • Give cardholders a period of 3 billing cycles to reject any rate increase
  • Prohibit credit card companies from changing the terms of their contract arbitrarily

If you feel you have been treated unfairly by your credit card company, and that they have broken any of these rules, you may want to consider taking legal action against them.

How can I possibly win a legal battle against my credit card company?

As an individual consumer it would be extremely difficult to take your credit card company to court. They have millions of dollars and seemingly unlimited legal resources, which they will use to fight your case. What you can do however, is file a class action lawsuit, in which an attorney will represent you and other consumers who have similar complaints.
