  • l Sending correspondence which can lead the person owing the debt to believe that the debt has actually been turned over to an attorney. It is also illegal for a company to falsely represent themselves as an attorney instead of a debt collection agency.

  • l Not including the purpose of the correspondence that an attempt to collect a debt is being made. It must be made clear to you that there is an attempt to collect a debt and there must be notice that any information the agency receives will be used for that reason, somewhere in the correspondence.
