Massachusetts OUI Laws: Third Offense and Beyond

A Massachusetts drunk driver who has committed 3 or more drunk driving offenses will have a felony placed on their record. In addition, the consequences for repeat drunk driving convictions in Massachusetts are more severe.

For example, a 5th time drunk driving offender may have to pay up to $50,000, will have to spend a minimum of 2 years in jail and may never again be able to drive legally with a driver's license.

Additional Penalties for Operating Under the Influence in Massachusetts

A Massachusetts drunk driver may be subject to additional penalties under one of Massachusetts' OUI laws commonly referred to as "Melanie's Law." For example, a convicted drunk driver who is operating a vehicle while intoxicated in spite of having a suspended license will have to serve a minimum of one year in jail.

Massachusetts OUI laws can also have an impact on a drunk driver's employer, as a drunk driver will not be able to be at work if the driver is in court or in jail. However, if an employer knowingly allows an employee with a suspended license to drive for company business, the employer can:

  • ? Be fined $500 for the 1st offense
  • ? Be fined up to $1000, spend up to 1 year in jail or both
  • ? Lose his license for up to a year, lose his registration for up to 1 year or both

Family and friends that allow a convicted drunk driver with a suspended license to drive, may also encounter legal troubles. Under the law, these people may be subject to the same penalties as an employer who knowingly allows a person with a suspended license to drive.

Family and friends also can't permit a person who is only allowed to drive a vehicle with an ignition interlock restriction to drive a car or truck that doesn't have this equipment installed. If they do, they are subject to the same penalties listed above. An ignition interlock device prevents a vehicle from being operated without the driver first taking a breathalyzer-type test. The driver also has to randomly repeat the test. This is to prevent someone else from taking the test to get the vehicle started.
