Massachusetts Child Restraint Laws

When seat belts were first invented, they were intended for passengers of all sizes and ages. But upon further study, experts determined that additional safety measures were needed to protect children from serious harm in a Massachusetts car accident.

To address this problem, lawmakers amended the Massachusetts seat belt laws to call for child restraint systems in cars that were carrying children. Depending on the age and size of the child, infant seats, car seats or booster seats may be required. Massachusetts child restraint laws include:

  • Child restraint seats are required for all children younger than 8 years old (unless the child is at least 4 feet 9 inches tall)
  • Child restraint seats are required for all children weighing 40 pounds or less

As with Massachusetts seat belt laws, there are a few exceptions to the child restraint laws. Massachusetts child restraint laws do not apply when:

  • Riding in a school bus
  • Riding in any vehicle manufactured before mid-1966
  • A child is unable to use a seat belt due to physical limitations
