Insurance Appeal Process Expanded for Owners of Recalled Toyota

February 10, 2010 - Boston - If you are the owner of a recalled Toyota, you deserve to feel safe in your vehicle and should not have to be in constant fear of experiencing a dangerous and life-threatening unexpected acceleration issue.

Additionally, you should not be held responsible for any financial expenses you may incur because of the Toyota recalls. If you were in a car accident that you believe was caused by the unexpected acceleration problem, and you were cited by your insurance company as being at-fault, know that you DO have options!

According to The Office of Consumer Affairs and Business Regulation, the Division of Insurance has expanded the appeal process for Toyota owners whose insurance company issued them an at-fault determination after a car accident involving a recalled vehicle.

If you have never before filed an appeal before the Board of Appeals, you may do so now. Additionally, if you already filed an appeal in which the insurance company's ruling was upheld, you may re-appeal now.

It's important to act fast! In both instances, you must request a rehearing within 60 days of receiving the notice of the Toyota recall. You must bring with you a copy of the Recall Notice, as well as the Surcharge Appeal Notice from your insurance company. If this is your first appeal, you will have to pay a $50 filing fee.

You will also be asked to show that your Toyota vehicle is one of the models that has been recalled, and that the car accident was caused by the unexpected acceleration problem. Below is a list of recalled Toyota vehicles: 

  • 2005-2010 Avalon
  • 2007-2010 Camry
  • 2009-2010 Corolla
  • 2008-2010 Highlander
  • 2009-2010 Matrix
  • 2004-2009 Prius
  • 2010 Prius
  • 2009-2010 RAV4
  • 2008-2010 Sequoia
  • 2005-2010 Tacoma
  • 2007-2010 Tundra
  • 2009-2010 VENZA
